Crest Hill man gets 30 years for strangling his wife to death

Will County State’s Attorney James Glasgow announces that a Crest Hill man who strangled his wife to death two years ago was sentenced to 30 years in prison Thursday morning.

Cesar Garcia, 29, pleaded guilty to first-degree murder in August. He killed Laura Gonzalez, 22, on Aug. 25, 2015. Police officers conducting a well-being check at the victim’s apartment found her body on a bed with the defendant lying next to her.

Garcia, who previously had been charged with domestic violence, was disoriented and lethargic. The defendant, who was not living at the apartment at the time, later admitted to police that he had strangled Gonzalez in the kitchen, telling her that if he can’t have her, no one else will. He then moved her to the bedroom, made some superficial cuts to his wrist, swallowed some pills, and took two sips of a household cleaner.

The victim also had injuries to her head and face as well as cuts to her wrists. She had become involved in a new relationship and had been trying to end her relationship with Garcia.

The case was prosecuted by Assistant State’s Attorney Peter Wilkes. Circuit Judge Amy Bertani-Tomczak handed down the sentence.

Joliet man guilty of girlfriend’s 2002 murder

Eric Glover

Will County State’s Attorney James Glasgow announced last week that a Joliet man who shot his longtime girlfriend while she was in bed with their young child has been found guilty of first-degree murder.

Eric Glover, 45, murdered Velma Franklin in the early-morning hours of June 17, 2002. Franklin and her 3-year-old daughter were lying in bed when Glover entered the room and shot the young mother in the head.

Glover fled the house after the shooting, leaving his frightened little daughter in the bed, where she remained until Franklin’s body was discovered the next morning by her other children.

Circuit Judge Carla Alessio Policandriotes found Glover guilty Nov. 15 at the conclusion of a seven-day bench trial. The defendant faces 45 years to life in prison when he is sentenced on Jan. 29.

Testimony at the trial revealed that Glover and Franklin had a stormy relationship and that the defendant had committed acts of domestic violence on prior occasions, one time slamming her head into a door frame.

Two months before Franklin was killed, Glover shot a .38-caliber weapon over her head while she was lying in bed, leaving the bullet in the wall. The bullet was retrieved from the wall on the day her body was discovered. It was found to be the same caliber as the bullet that was removed from the victim’s head during the autopsy.

In addition, Franklin’s daughter, in a recorded interview at the Will County Children’s Advocacy Center, told officials that her father had shot her mother.

The case was charged in 2002 but dismissed by a prior administration in the Will County State’s Attorney’s Office. However, Jim Stewart, a retired Joliet Police Captain who took over as chief of the Investigations Division for the Will County State’s Attorney’s Office in 2010, urged State’s Attorney Glasgow to review the case and reinstate it in 2012. Sadly, Stewart passed away days before the verdict.

“This guilty verdict my prosecutors secured today is a testament to Jim Stewart’s dogged determination and his desire for justice on behalf of Velma Franklin,” State’s Attorney Glasgow said. “This case would never have gotten another look and a cowardly murderer would still be free if Jim Stewart had not championed the cause.”

The State’s Attorney also credited his prosecutors, Frank Byers, Christine Vukmir, and John Rickmon for their excellent trial work that secured this important verdict.

Naperville man changed with aggravated battery after Will County Forest Preserve Police investigation

A Forest Preserve District of Will County Police investigation has resulted in an aggravated battery charge being filed against William P. Sitton, 23, of Naperville, for a May incident on the Old Plank Road Trail.

Sitton was arraigned on the charge Nov. 30, in Will County Court, where he pleaded not guilty. A date for pretrial motions was set for Jan. 10.

The OPRT incident occurred at approximately 6:20 p.m. May 28 when a 21-year-old woman told police a man grabbed her arm and then her waist as she walked near the entrance to a path that connects the trail to the Hickory Creek Bikeway in New Lenox Township. She was able to flee the scene with her dog.

After receiving information from a local bar, Forest Preserve police publicized a photo of two men: a witness to the attack and the suspect who grabbed the victim. Tips from the public led to the witness being identified, and several grand jury appearances led to Sitton being arrested.

“Forest Preserve officers were able to obtain an arrest warrant for the suspect and on Oct. 31, he was apprehended in Champaign where he is attending college,” said Forest Preserve Police Chief Tracy Chapman.

Sitton was released on bond after his arrest.

Chapman praised her officers for their hard work and members of the public for their help.

“Our officers worked tirelessly to make an arrest in this case,” she said. “We want to thank the public for their cooperation, and let them know that their safety is our No. 1 goal.”

Forest Preserve Board President Suzanne Hart also expressed appreciation for the efforts involved in identifying the suspect.

“Our forest preserves and trails are among Will County’s most valuable assets and we take visitor safety very seriously,” Hart said. “I’m proud of the way our Forest Preserve police have pursued this case, and I look forward to its final legal resolution.”

The charge of aggravated battery in a public place pending against Sitton is a Class 3 felony punishable by up to two to five years in prison and a fine of up to $25,000.

At approximately 12:24 a.m., on Dec. 3, deputies from the Will County Sheriff’s Office were dispatched to 1462 Sterling Avenue in unincorporated Joliet Township in reference to a person being shot. Upon arrival, deputies located a deceased male on the second floor of a residence with an apparent gunshot wound to the head. The victim was later identified as Ricardo Perez, 36, of Joliet.

Numerous patrol deputies, detectives and crime scene personnel assisted in the securing of the residence, and a search warrant was obtained to help further the investigation.

Man receives 100 years for 1999 sexual assault in Lisle

Roberto Noyola-Espinal

DuPage County State’s Attorney Robert B. Berlin announced last week that Roberto Noyola-Espinal, 41, formerly of Texas, was sentenced to 100 years in the Illinois Department of Corrections for forcing his way into a Lisle woman’s home and sexually assaulting her in 1999. On June 9, following a four-day-long bench trial, Judge Robert Miller found Noyola-Espinal guilty of one count of Home Invasion and three counts of Aggravated Criminal Sexual Assault, all Class X Felonies.

Noyola-Espinal has been in the DuPage County Jail since March 2014 following a Bond Court appearance where bond was set at $1 million.

On February 7, 1999, Noyola-Espinal approached the then 63-year-old woman’s apartment in Lisle and knocked on her patio door. Thinking it was a friend of hers, the woman began to open the door. Once she realized she did not know the person knocking on the door, the woman attempted to close the door. Noyola-Espinal forced the door open however, and entered the apartment. Once inside the apartment, Noyola-Espinal physically and sexually assaulted the woman. He then fled the state, eventually settling in Mexico. The victim then went to her neighbor’s home and called the police.

Following an investigation led by the Lisle Police Department, a DNA profile of the suspect was entered into the federal Combined DNA Index System (CODIS).

The investigation of the assault continued throughout the years. In October 2013, Noyola-Espinal was arrested in Houston, Tex., for illegally re-entering the United States from Mexico, where he had eventually settled. A DNA sample taken from Noyola-Espinal at that time resulted in a CODIS hit on the DNA collected from the 1999 sexual assault Noyola-Espinal committed in Lisle.

On February 27, 2014, Noyola-Espinal was extradited from Texas and returned to DuPage County to face the charges. An investigation into the assault revealed that Noyola-Espinal had been deported from the United States in 1998 and that he had illegally returned to the United States just months before committing the Lisle sexual assault.

“Seventeen years is a long time,” Berlin said. “But since that day when Roberto Noyola-Espinal forced his way into his victim’s home and committed unspeakable acts against an unsuspecting, innocent woman, justice has been patiently waiting. Justice caught up with Mr. Noyola-Espinal to the tune of one hundred years. While justice may have been a long time coming, today Mr. Noyola-Espinal learned that he will spend the rest of his life behind bars for the atrocious acts he committed so many years ago.”

“I would like to commend the men and women of the Lisle Police Department, particularly Detective Chris Loudon, for their persistence and dedication in this case. They never gave up. I would also like to thank the Illinois State Police as well as the Downers Grove Police Department, particularly Officer Javier Guzman for their efforts in bringing this case to a successful conclusion. It is because of their outstanding work Mr. Noyola-Espinal is looking at a well-deserved sentence of one hundred years. I would also like to thank members of the DuPage County Forensic Science Center for their assistance on this case as well as Assistant State’s Attorneys Jennifer Lindt and Mike Fisher for their work in holding Mr. Noyola-Espinal responsible for his actions.”

Noyola-Espinal must serve 85 percent of his sentence before being eligible for parole.

Shane Smith

Will County State’s Attorney James Glasgow announced that a Joliet man who choked his mother to death and dumped her body in the Des Plaines River near the Brandon Road Lock and Dam has been sentenced to 32 years in prison.

Shane Smith, 37, of the 1600 block of Black Road, pleaded guilty to one count of First-Degree Murder in June for killing Joan Smith at her house during an argument on Oct. 13, 2013.

Circuit Judge Carla Alessio Policandriotes handed down the sentence last week.

Smith, who lived with his mother, had been drinking and fishing near the Brandon Road Lock with his wife on the day of the argument. Joan Smith would not allow her son’s wife to live in her house because of frequent arguments between the couple.

The dispute with his mother began when Shane Smith attempted to sneak his wife into the house that evening. Joan Smith told her to leave. Shane Smith left as well, but he returned alone later that evening and began arguing with his mother. During that dispute, he choked his mother to death, placed her body in a garbage bag and drove her to the Brandon Road Lock. He dropped her body in the river where it was discovered downstream several days later.

Shane Smith, who threw the jeans he had been wearing during the murder into the river, told his wife what he had done. She made a statement to Joliet police, who recovered the jeans. Investigators also matched DNA from the victim with hair that was found on her driveway near the wheel of her vehicle.

“Shane Smith is a selfish coward who killed his defenseless mother because he could not abide by her house rules,” said State’s Attorney Glasgow. “The vicious nature of this murder demonstrates the dark depths of this defendant’s depraved heart.”

Smith had prior convictions and served prison time for aggravated robbery in 2000 and an aggravated domestic battery in 20018.

State’s Attorney Glasgow thanked Joliet police for their excellent investigation as well as his prosecutors, Mark Fleszewski, Katheryn Tinich, and Tom Slazyk, who had prepared a strong case for trial.

DuPage County State’s Attorney Robert B. Berlin announced today that a Downers Grove man charged with repeatedly shaking his three-month-old daughter was sentenced to 12 years in the Illinois Department of Corrections. Timothy Churchill, 22 of 4220 Lindley, appeared in court this morning where he entered a plea of guilty to one count of Aggravated Battery to a Child, (Class X Felony) in front of Judge John Kinsella, who handed down the sentence. On February 3, 2016, Churchill appeared in bond court where bond was set at $1 million. He remained in custody since that then.

On January 23, 2016, at approximately 2 a.m., Churchill and the mother of his daughter, who lives in Naperville, brought the girl to the emergency room at Edward Hospital in Naperville. The baby was unresponsive. Upon discovering substantial head injuries, the baby was transported to Lurie Children’s Hospital where she underwent emergency brain surgery to relieve intracranial pressure. An investigation conducted by the Naperville Police Department into the source of the infant’s injuries revealed that Churchill violently shook his daughter causing significant head injuries including bilateral subdural hematomas and retinal hemorrhaging.

“The sentence handed down by Judge Kinsella this morning underscores the severity of the injuries that Mr. Churchill inflicted upon his own infant daughter,” Berlin said. “Child abuse has no place in a civilized society and remains a top priority in my office as the victims in such cases are arguably society’s most vulnerable. I would like to thank the Naperville Police Department for their efforts on this heartbreaking case. I would like to thank the medical staffs at Edward Hospital as well as Lurie Children’s Hospital for the outstanding care they provided to this young victim. I would also like to thank the DuPage County Children’s Center as well as Assistant State’s Attorneys Cathy DeLaMar and Michael Pawl for their efforts in holding Mr. Churchill responsible for what he did to his own daughter.”

Churchill must serve 85 percent of his sentence before being eligible for parole.
